Welcome to myboxingclasses.com, including all of its subdomains and landing pages (the "Site"). The Site is operated by LightUp Digital, obrt za marketing, vl. Goran Horina, doing business as LUD Agency (official website: lud-agency.com). These Terms of Use govern your access to and use of the Site and any associated landing pages we manage on behalf of independently owned boxing and martial arts gyms ("Partner Gyms"). By using the Site, you accept these Terms.

1. Independent Marketing Agency

LUD Agency is an independent marketing agency providing digital advertising and lead generation services on behalf of Partner Gyms. All promotions, offers, and content displayed on the Site are created exclusively for the individual gyms that have engaged our agency. We are not a gym, and we are not affiliated with, endorsed by, or acting on behalf of any franchise corporate team, sanctioning body, or sports federation. Any reference to a gym's name identifies that specific business only and does not imply any wider endorsement, sponsorship, or partnership.

2. Trademarks and Nominative Fair Use

We respect the intellectual property rights of all parties. Gym names, logos, and related marks may appear on the Site solely to identify the Partner Gyms that have engaged LUD Agency as their authorized marketing representative. We use these marks:

  • Only with the permission of the individual gym;
  • Solely to promote that specific gym's services, in a way that does not suggest affiliation with or endorsement by any third party;
  • Consistent with the doctrine of nominative fair use, including under U.S. trademark law (Lanham Act §§1114 and 1125) where applicable.

We do not claim ownership of any third-party trademarks. If you are a trademark owner and believe any use on the Site exceeds these limits, please contact us and we will promptly address the concern.

3. Offers and Bookings

Intro offers and promotions displayed on the Site are provided and fulfilled by the individual Partner Gym, not by LUD Agency. All offers are subject to the gym's availability, schedule, and its own terms, waivers, and house rules. Prices are set by the gym and may change. Unless stated otherwise, intro offers are limited to one per person and are intended for new students only. Any contractual relationship for training services is formed directly between you and the gym.

4. Health and Safety Notice

Boxing, martial arts, and similar training programs are physically demanding activities that carry an inherent risk of injury. Before starting any training program, consult your physician, especially if you have a medical condition, are pregnant, or have been inactive. Participation in any class is at your own risk and subject to the waiver and safety rules of the gym you attend. Nothing on the Site constitutes medical advice.

5. Communications

By submitting a form on the Site, you consent to being contacted about your inquiry by phone, text message, and email, as described in our Privacy Policy. You can opt out of messages at any time (reply STOP to text messages).

6. Acceptable Use

You agree not to misuse the Site, including by submitting false information, interfering with its operation, attempting unauthorized access, scraping content, or using the Site for any unlawful purpose.

7. Intellectual Property

Unless otherwise stated, the design, text, and other content of the Site created by LUD Agency are our property or the property of our Partner Gyms and may not be reproduced without permission.

8. Disclaimers and Limitation of Liability

The Site is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, LUD Agency is not liable for any damages arising from your use of the Site, or from services provided by any Partner Gym, including participation in training. Nothing in these Terms limits liability that cannot be limited under applicable law, and consumers in the EU retain all mandatory statutory rights.

9. Third-Party Links

The Site may contain links to third-party websites (for example, a gym's own website or booking tools). We are not responsible for their content or practices.

10. Governing Law

These Terms are governed by the laws of the Republic of Croatia. Any disputes will be subject to the jurisdiction of the competent court in Zagreb, without prejudice to mandatory consumer protections available in your country of residence. If any provision of these Terms is found invalid, the remaining provisions remain in effect.

11. Changes

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the Site after changes constitutes acceptance.
